At CarArt.com ("CarArt"), we care about your privacy and are committed to protecting it. This privacy policy tells you about the kind of information we collect and how we use it. By using our web site, you authorize the collection and use of your information as described in this policy. CarArt may update this privacy policy. We will notify you about material changes to this policy by emailing you and/or placing a notice on our Website. Your continued use of the CarArt.com Website will be subject to the then current privacy policy.

How we collect information about you
When you visit the CarArt website, we collect your IP address and standard web log information, such as your browser type and the pages you accessed on our website.

If you open an account, we collect the following types of information from you:
  • Contact information - your name, address, phone, email, and other similar information.
  • Financial information – the credit card numbers that you use to make purchases with CarArt
When you are using our Service, we collect information about your account transactions and we may collect information about your computer or other access device for fraud prevention purposes. We also collect information regarding your use of our website, including your page views, your published images, your browsing paths, the graphic images you work with in our Design Studio, etc. Finally, we may collect additional information from or about you in other ways not specifically described here. For example, we may collect information related to your contact with our customer support team or store results when you respond to a survey.

Uploading Information to CarArt.com
Upon registration for a CarArt.com account, you will select a user name and password. When you upload an image, post a comment or message on the Website, or interact with others through our Website, your user name is visible to other users. Additionally, if your comment or message contains personal information and is posted by you in a page that is accessible to the public, third parties may collect that information and send you unsolicited messages. Any content or information you upload is not considered personally identifiable information subject to this Privacy Policy. Think first before posting such information.

How We Use Cookies
When you access our website, we, or companies we hire to track how our website is used, may place small data files called "cookies" on your computer.

We send a "session cookie" to your computer when you log in to your account. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session, so that we don't need to ask you for your password on each page. Once you log out or close your browser, this cookie expires and no longer has any effect.

We also use longer-lasting cookies to display your e-mail address on our sign-in form, so that you don't need to retype the e-mail address each time you log in to your account.

Information Collected by Web Beacons and Log Files
CarArt collects certain non-personally identifiable information through the use of web beacons and log files. Such information may include your IP address, browser type, site usage, and whether you opened emails you received from us.

How we protect and store personal information
Throughout this policy, we use the term "personal information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user.

We store and process your personal information on our computers in the US, and we protect it by maintaining physical, electronic and procedural safeguards in compliance with applicable US federal and state regulations. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities.

How we use the personal information we collect
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. We may use your personal information to:
  • provide the services and customer support you request;
  • process transactions and send notices about your transactions
  • resolve disputes and troubleshoot problems;
  • prevent potentially prohibited or illegal activities, and enforce our Terms of Service and our Intellectual Property Policy;
  • customize, measure, and improve our services and the content and layout of our website;
  • send you targeted marketing, service update notices, and promotional offers based on your communication preferences;
  • compare information for accuracy and verify it with third parties.

How we share personal information with other CarArt users
When we display your published images in the Image Marketplace, we will display to users your name or artist name. We may also display the date each image was published to the Image Marketplace. While we will never publish the exact amount of Royalties you have earned, we may list you as a top Artist or on a similar list, if you are among the highest earning Artists on the CarArt Website.

If you are buying goods or services from a seller that will ship you Products directly to you, and if you pay through CarArt, we may provide the seller with the shipping address for the goods and your confirmed credit card billing address to complete your transaction with the seller. The seller is not allowed to use this information to market their other products and/or services to you unless you specifically agree to it.

We will not disclose your credit card number or bank account number to anyone you have paid through CarArt, except with your express permission or if we are required to do so to comply with a subpoena or other legal process.

How we share personal information with other parties
We may share your personal information with:
  • Members of our corporate family to help our Artists earn more royalties on their published images by providing made-to-order Products other than vinyl vehicle graphics, by providing joint services and for other business purposes.
  • Service providers under contract who help with parts of our business operations; (fraud prevention, credit card processing, marketing, technology services). Our contracts dictate that these service providers only use your information in connection with the services they perform for us and not for their own benefit.
  • Financial institutions that we partner with to offer financing for CarArt Products (and only then in cases where you have opted to utilize such financing offers).
  • Credit bureaus to report outstanding negative balance accounts, as allowed by law.
  • Companies that we plan to merge with or be acquired by. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information could be used contrary to this policy, you will receive prior notice.)
  • Law enforcement, government officials, or other third parties when
    • we are compelled to do so by a subpoena, court order or similar legal procedure
    • we need to do so to comply with law
    • we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our User Agreement.
  • Other third parties with your consent or direction to do so.
CarArt will not sell or rent any of your personal information to third parties in the normal course of doing business and only shares your personal information with third parties as described in this policy.

How you can access or change your personal information
You can review your personal information and make any necessary changes, at any time by logging in to your account and changing your preferences in the My Profile page of the "My Account" tab.

How do we secure your information?
When you place orders or access your account information, we use commercially reasonable and generally-accepted technological safeguards to secure any information we collect about you. The secure server software (SSL) we use encrypts all information you input before it is sent to us. In addition, your CarArt account information is password-protected for your privacy and security. You should always take steps to protect the confidentiality of the password you select.

We use your email address to communicate with you about your account, your orders, your royalty earnings (if any), and to send you certain notification emails.

We do not use your email address or other personally identifiable information to send marketing messages without your consent. Similarly, if you email a product to a friend or refer a friend to the CarArt Website or our promotions, we will use your friend's email to send them the e-mail you requested. You and your friend's e-mail addresses will only be used for this purpose unless permission is otherwise granted.

We use non-personally identifiable information to monitor the use and performance of the CarArt Website so that we can learn more about how people use the CarArt Website and improve our products and services.

Does CarArt disclose the information it collects to outside parties?
Generally, CarArt does not share personal information about you with other people or nonaffiliated companies without your consent except that:

CarArt provides information to its agents and trusted service providers and contractors for limited purposes, such as: fulfilling customer orders and processing credit card transactions; offering certain products and services; communicating with customers; providing customer service; managing information on our behalf; and enhancing the CarArt Website features and functionality. In such cases, we require that these parties agree to use the information solely for the purpose for which we provided it to them and in accordance with our privacy policy.

If you sign up for a CarArt sponsored contest or promotion, or if you enroll in a service offered in partnership with a third party, CarArt may provide information (such as your name, email address, and account activity) to such third parties.

CarArt may also release information (including your name, addresses, telephone number, and account activity) when we, in our sole discretion believe that such release is necessary or appropriate to:

  • comply with law;
  • comply with subpoenas, warrants, court orders, government investigations, or other legal process;
  • enforce or apply the terms of any of our user or license agreements;
  • investigate or respond to allegations of fraud, intellectual property infringement, or other unlawful activity
  • protect the rights, property or safety of CarArt, our users, or others.

CarArt may, upon being acquired by or merging with another company, transfer all personal information that we have collected from our users to the resulting company. CarArt may disclose non-personally-identifiable information to third parties in aggregate form to potential business partners and investors.

Children’s Privacy
Children under the age of thirteen are allowed to upload graphics and images and to order products with their parent's consent. To order products, the child (as with other purchasers) must indicate his or her age, submit his or her name and his or her mailing address and shipping address if different from the mailing address together with a valid credit card number.

This information is used to fulfill the requested order; confirm shipment; complete record keeping including royalty entitlements and pay royalty fees, if any, and to advise the child concerning new CarArt products, services or policies.

Parents of children under the age of 18 have the option to consent to the collection of this information from their children or not. Such consent will not be used as consent for the dissemination of any of this information and the information will not be released by CarArt to third parties without the parents' consent except as may be required by law or upon court order.

Personal information supplied to CarArt is kept confidential and is disclosed only with the consent of the CarArt user or as described in this Privacy Policy. CarArt doesn’t sell data that reveals the individual browsing or buying habits, or the demographic information, of our users.

Parents or legal guardians of children between the ages of 13 and 18 years old can request from CarArt a review of all content and information supplied to CarArt their child. At the parent or guardian’s request, CarArt will delete from our records any such information.
